Inspiracles License – Content Usage

Uploading Content

By uploading Content to the Website, you grant Inspiracles (a trademark of Bernhard Rauscher) an irrevocable, worldwide, non-exclusive, royalty-free license to use, copy or modify the Content for both commercial and non-commercial purposes. You are responsible for your uploaded Content and warrant that: a. you own all rights to the Content you upload to the Website and that the Content does not infringe any copyright, proprietary right, trademark or other applicable rights of any third party; and b. you own all rights to the Content necessary for its worldwide, irrevocable and perpetual use and assign and/or transfer such rights to the extent permitted by law. This includes in particular valid model contracts, photography permission, as well as other licenses and rights of third parties.

Release of Liability

You agree to indemnify Inspiracles from and against any and all claims made by third parties against Inspiracles due to infringement of their rights by content provided by you or by its other use of the applications available through Inspiracles. You assume the costs of a necessary legal defense of Inspiracles including all court and attorney fees in the statutory amount. This does not apply if the infringement is not your fault. In the event of a claim by a third party, you are obligated to immediately, truthfully and completely provide Inspiracles with all information available to you, which is necessary for an examination of the claims and a defense. Any further claims for damages by Inspiracles against you remain unaffected.

Naming of the copyright holder

Inspiracles will name you as the copyright holder at Inspiracles’ discretion either at the place on the publication where Inspiracles embeds the content (especially images) or at another suitable place on the publication, as the author or owner of the exploitation rights to the content. You should inform us if and with which content you want to be named as author or owner. If you do not provide us with a copyright notice or the name of the copyright holder, Inspiracles has the right to name the copyright holder and you waive any further rights.

Applicable Law

The contractual relationship between users and Inspiracles shall be governed by the laws of the Federal Republic of Germany. As far as permissible, the place of jurisdiction is agreed to be Munich.

Severability Clause
